CCPA Imposes ₹44 Lakh Penalty on Major E-Commerce Platforms Over Illegal Walkie-Talkie Listings

 

India’s Central Consumer Protection Authority (CCPA) has imposed cumulative penalties amounting to ₹44 lakh on several prominent e-commerce and online marketplace platforms, including Meta (Facebook Marketplace), Amazon, Flipkart, Meesho, JioMart, and a few other sellers, for facilitating the sale of unauthorised walkie-talkie devices on their platforms.

The action was taken following a suo motu investigation by the CCPA after authorities observed that multiple walkie-talkie products listed online were being sold without complying with mandatory regulatory requirements under Indian law. According to official statements, these devices lacked proper disclosures, approvals, and certifications required for radio communication equipment in India.


Nature of the Violation

Walkie-talkies and similar radio communication devices fall under the purview of India’s telecom and wireless regulations. Such products are required to operate within permitted frequency bands and must carry necessary approvals, including Equipment Type Approval (ETA) where applicable. The CCPA noted that many listings failed to clearly mention frequency details, licensing requirements, or regulatory compliance, potentially misleading consumers.

Authorities highlighted that unauthorised radio devices may pose interference, security, and safety concerns, making regulatory oversight essential.


Penalty Structure

As per reports, Meta, Amazon, Flipkart, and Meesho were each fined ₹10 lakh, while JioMart and certain individual sellers or smaller platforms were fined lower amounts, bringing the total penalty to ₹44 lakh. The fines were imposed under provisions of the Consumer Protection Act, 2019, which holds platforms accountable for misleading listings and non-compliant products offered through their services.


Responsibility of Online Marketplaces

The CCPA reiterated that e-commerce platforms are expected to exercise due diligence and ensure that products sold through their marketplaces comply with applicable laws. While the authority did not accuse platforms of manufacturing the devices, it emphasized their responsibility to monitor listings, remove non-compliant products, and protect consumer interests.

Platforms have reportedly been directed to strengthen internal review mechanisms and ensure better compliance with regulatory standards going forward.

This enforcement action is seen as part of a broader regulatory push by Indian authorities to tighten oversight of online marketplaces, especially for products linked to public safety, telecommunications, and consumer rights.
